On September 29th, the Equal Employment Opportunity Commission (EEOC) published an updated EEO-1 reporting form.  The new form will require covered employers to provide employee pay data (based on employee W-2 data) beginning in March 2018. This new form will allow EEOC investigations to easily review possible pay discrimination based on gender, race and ethnicity.

Employers required to complete the EEO-1 Survey Report include private employers with 100 or more employees and federal contractors with 50 or more employees.  However, federal contractors with 50-99 employees only have to submit the demographic data, not the new pay data.

The new information must be provided in the 2017 form (due March 31, 2018), and to give employers time to collect that data, the deadline for 2017 will be extended by six months from September 30, 2017 to March 31, 2018.  For more information on the new form or to discuss conducting a self-audit to determine any existing pay disparities and how they can be resolved or explained, contact our office.
